Obama nears deadline on gay marriage decision

WASHINGTON (AP) ? The next phase of President Barack Obama's evolution on gay marriage may come with the deadline for his administration to weigh in on a landmark Supreme Court case that could determine whether same-sex couples have a constitutional right to wed.

Gay rights supporters are pressing the administration to file a friend-of-the-court brief urging the justices to overturn California's gay marriage ban. Obama is not required to file a brief, though he raised expectations in his second inaugural address when he declared that gays and lesbians must be "treated like anyone else under the law."

An administration brief would not be legally binding. But it could offer the clearest insight into Obama's views on gay marriage, which he supports but has said should be governed by the states.

Ahead of Thursday's deadline, dozens of prominent Republicans signed a friend of the court brief asking the justices to declare California's Proposition 8 ballot measure unconstitutional. Among them are former GOP presidential candidate Jon Huntsman and Florida Rep. Ileana Ros-Lehtinen.

The Proposition 8 ballot initiative was approved by California voters in 2008 in response to a state Supreme Court decision that had allowed gay marriage. Twenty-nine other states have constitutional amendments banning gay marriage, while nine states and the District of Columbia recognize same-sex marriage.

Gay rights advocates are anticipating the administration filing a broad brief, one that would ask the justices to not only strike down the California measure, but also rule that the Constitution forbids any state from banning same-sex unions. But the administration could also file a narrower brief applying only to California.

Even the latter brief would appear to mark a shift away from the president's contention that states have the right to determine whether to allow same-sex marriages.

While an administration brief alone is unlikely to sway the high court, the government's opinion does carry weight with the justices.

Solicitor General Donald Verrilli would formally file a brief, though he has been consulting with White House officials. And it's almost certain that Obama, a former constitutional law professor, made the administration's final decision.

In his inaugural address, the president said the nation's journey "is not complete until our gay brothers and sisters are treated like anyone else under the law."

"For if we are truly created equal, than surely the love we commit to one another must be equal as well," he said.

Obama has a complicated history on gay marriage. As a presidential candidate in 2008, he opposed the California ban but didn't endorse gay marriage. As he ran for re-election last year, he announced his personal support for same-sex marriage but said marriage was an issue that should be decided by the states, not the federal government.

Public opinion has shifted in support of gay marriage in recent years. In May 2008, Gallup found that 56 percent of Americans felt same-sex marriages should not be recognized by the law as valid. By November 2012, 53 percent felt they should be legally recognized.

The Supreme Court will hear oral arguments in the Proposition 8 case on March 26. One day later, the justices will hear arguments on another gay marriage case, this one involving provisions of the federal Defense of Marriage Act. The act defines marriage as between a man and a woman for the purpose of deciding who can receive a range of federal benefits.

The Obama administration abandoned its defense of the law in 2011 but continues to enforce it. In a brief filed last week, the government said Section 3 of DOMA "violates the fundamental constitutional guarantee of equal protection" because it denies legally married same-sex couples many federal benefits that are available only to legally married heterosexual couples.

President Obama and congressional leaders unveil a statue to honor civil rights leader Rosa Parks in the rotunda of the U.S. Capitol.

More than half a century after she refused to give up her seat on an Alabama city bus, Rosa Parks has an immovable place in the U.S. Capitol ? the first black woman to be honored with a statue there.

President Barack Obama and congressional leaders from both parties said at an unveiling Wednesday that the depiction was fitting: Parks is shown seated, hands clasped in front of her, eyes fixed forward.

?Rosa Parks? singular act of disobedience launched a movement,? Obama said. ?The tired feet of those who walked the dusty roads of Montgomery helped a nation see that to which it had once been blind.?

On Dec. 1, 1955, Parks, then a 42-year-old seamstress, broke the law by refusing to give up her seat to a white passenger on a packed bus. Her arrest touched off a yearlong boycott of the bus system, a turning point in the civil rights movement. In 1956, the Supreme Court banned segregation on public transportation.

Parks died in October 2005, at age 92, and would have turned 100 this month.

On Wednesday, Rep. James Clyburn, D-S.C., and the highest-ranking black member of Congress, called her ?the first lady of civil rights, the mother of the movement, the saint of an endless struggle.?

The statue?s unveiling took place on a day when memories of the civil rights struggle were not far from mind in Washington. Across the street, with Clyburn watching, the Supreme Court heard arguments on whether provisions of the Voting Rights Act of 1965 should stand. The act requires nine states, mostly in the South, to get federal permission to change voting rules.

The statue of Parks, 9 feet tall and in bronze, will be in Statuary Hall, where the House of Representatives met in the early 1800s. It is part of a collection of 100 in five locations in the Capitol.

Among the others in Statuary Hall are William Jennings Bryan and Daniel Webster. House Speaker John Boehner pointed out that the statue of Parks will be ?right in the gaze? of that of Jefferson Davis, president of the Confederacy. He said her unassuming presence should inspire people to ?draw strength from stillness.?

Parks was given the Presidential Medal of Freedom in 1996 and the Congressional Gold Medal in 1999, but Rhea McCauley, a niece, told The Associated Press before the unveiling that this honor would be different.

?The medal, you could take it, put it on a mantel,? she said. ?But her being in the hall itself is permanent.?

More than 50 of Parks? relatives had planned to attend the ceremony, and two of them, a niece and a longtime friend, helped Obama and congressional leaders yank down the shroud that covered the statue.

The sculptor was Eugene Daub of San Pedro, Calif.

?She seemed to me a very ? not shy, but modest. A very modest woman, and I wanted that to come through,? he told NBC News. ?That she wasn?t ever looking for attention or celebrity, but she was just doing what she had to do.?

Obama said that Parks? story is a reminder that ?we so often spend our lives as if in a fog, accepting injustice, rationalizing inequity? ? like the bus driver, he said, but also like the other passengers.

?Rosa Parks tells us there?s always something we can do,? he said.

President Obama joined Congressional leaders today on Capitol Hill to unveil a new statue of Rosa Parks. Sculptor Eugene Daub told NBC News how he felt creating the likeness of one of the most definitive characters in American history.

There's no question that Corning has had a big impact on mobile devices in recent years with its Gorilla Glass, and it's hoping for similar success in the years ahead with its new Willow Glass technology. It looks like there's still a bit of a wait in store before we'll see products that fully take advantage of the glass's bendy properties, though. Speaking with Bloomberg, Corning president James Clappin says that products with flexible displays are likely still three years out, adding that it's now busy making "a lot of effort" to teach what it describes as "very big name" companies how to fully use the product. Clappin did reiterate the company's earlier that we will see some products using Willow Glass as early as this year, although those will likely take the form of simpler products; he offered a flexible barrier for solar panels and a thin film behind touch panels as some examples.

Non-brittle glass possible: In probing mysteries of glass, researchers find a key to toughness

Feb. 26, 2013 ? In a paper published online Feb. 26 in the journal Nature Communications, a Yale University team and collaborators propose a way of predicting whether a given glass will be brittle or ductile -- a desirable property typically associated with metals like steel or aluminum -- and assert that any glass could have either quality.

Ductility refers to a material's plasticity, or its ability to change shape without breaking.

"Most of us think of glasses as brittle, but our finding shows that any glass can be made ductile or brittle," said Jan Schroers, a professor of mechanical engineering and materials science at Yale, who led the research with Golden Kumar, a professor at Texas Tech University. "We identified a special temperature that tells you whether you form a ductile or brittle glass."

The key to forming a ductile glass, they said, is cooling it fast. Exactly how fast depends on the nature of the specific glass.

Focusing on a new group of glasses known as bulk metallic glasses (BMGs) -- metal alloys, or blends, that can be extremely pliable yet also as strong as steel -- researchers studied the effect of a so-called critical fictive temperature (CFT) on the glasses' mechanical properties at room temperature.

When forming from liquid, there is a temperature at which glass becomes too viscous for reconfiguration and freezes. This temperature is called the glass transition temperature. Based on experiments with three representative bulk metallic glasses, the researchers said there is also, for each distinct alloy, a critical temperature that determines the brittleness or plasticity of the glass. This is the CFT.

Researchers said it's possible to categorize glasses in two groups -- those that will be brittle because in liquid form their CFT is above the glass transition temperature, and those that will be ductile, because in liquid form their CFT is below the glass transition temperature.

They previously thought a liquid's chemical composition alone would determine whether a glass would be brittle or ductile.

"That's not the case," Schroers said. "We can make any glass theoretically ductile or brittle. And it is the critical fictive temperature which determines how experimentally difficult it is to make a ductile glass. That is the major contribution of this work."

The finding applies theoretically to all glasses, not metallic glasses only, he said.

"A glass can have completely different properties depending on the rate at which you cool it," Schroers said. "If you cool it fast, it is very ductile, and if you cool it slow it?s very brittle. We anticipate that our finding will contribute to the design of ductile glasses, and in general contribute to a deeper understanding of glass formation."

Pain from the brain: Diseases formerly known as 'hysterical' illnesses

Feb. 24, 2013 ? Psychogenic diseases, formerly known as 'hysterical' illnesses, can have many severe symptoms such as painful cramps or paralysis but without any physical explanation. However, new research from the University of Cambridge and UCL (University College London) suggests that individuals with psychogenic disease, that is to say physical illness that stems from emotional or mental stresses, do have brains that function differently. The research was published February 25, in the journal Brain.

Psychogenic diseases may look very similar to illnesses caused by damage to nerves, the brain or the muscles, or similar to genetic diseases of the nervous system. However, unlike organic diseases, psychogenic diseases do not have any apparent physical cause, making them difficult to diagnose and even more difficult to treat.

"The processes leading to these disorders are poorly understood, complex and highly variable. As a result, treatments are also complex, often lengthy and in many cases there is poor recovery. In order to improve treatment of these disorders, it is important to first understand the underlying mechanism," said Dr James Rowe from the University of Cambridge.

The study looked at people with either psychogenic or organic dystonia, as well as healthy people with no dystonia. Both types of dystonia caused painful and disabling muscle contractions affecting the leg. The organic patient group had a gene mutation (the DYT1 gene) that caused their dystonia. The psychogenic patients had the symptoms of dystonia but did not have any physical explanation for the disease, even after extensive investigations.

The scientists performed PET brain scans on the volunteers at UCL, to measure the blood flow and brain activity of both of the groups, and healthy volunteers. The participants were scanned with three different foot positions: resting, moving their foot, and holding their leg in a dystonic position. The electrical activity of the leg muscles was measured at the same time to determine which muscles were engaged during the scans.

The researchers found that the brain function of individuals with the psychogenic illness was not normal. The changes were, however, very different from the brains of individuals with the organic (genetic) disease.

Dr Anette Schrag, from UCL, said: "Finding abnormalities of brain function that are very different from those in the organic form of dystonia opens up a way for researchers to learn how psychological factors can, by changing brain function, lead to physical problems."

Dr Rowe added: "What struck me was just how very different the abnormal brain function was in patients with the genetic and the psychogenic dystonia. Even more striking was that the differences were there all the time, whether the patients were resting or trying to move."

Additionally, the researchers found that one part of the brain previously thought to indicate psychogenic disease is unreliable: abnormal activity of the prefrontal cortex was thought to be the hallmark of psychogenic diseases. In this study, the scientists showed that this abnormality is not unique to psychogenic disease, since activity was also present in the patients with the genetic cause of dystonia when they tried to move their foot.

Dr Arpan Mehta, from the University of Cambridge, said: "It is interesting that, despite the differences, both types of patient had one thing in common -- a problem at the front of the brain. This area controls attention to our movements and although the abnormality is not unique to psychogenic dystonia, it is part of the problem."

This type of illness is very common. Dr Schrag said: "One in six patients that see a neurologist has a psychogenic illness. They are as ill as someone with organic disease, but with a different cause and different treatment needs. Understanding these disorders, diagnosing them early and finding the right treatment are all clearly very important. We are hopeful that these results might help doctors and patients understand the mechanism leading to this disorder, and guide better treatments."

Hummingbird flight: Two vortex trails with one stroke

Feb. 25, 2013 ? As of today (February 25), the Wikipedia entry for the hummingbird explains that the bird's flight generates in its wake a single trail of vortices that helps the bird hover. But after conducting experiments with hummingbirds in the lab, researchers at the University of California, Riverside propose that the hovering hummingbird instead produces two trails of vortices -- one under each wing per stroke -- that help generate the aerodynamic forces required for the bird to power and control its flight.

The results of the study could find wide application in aerospace technology and the development of unmanned vehicles for medical surveillance after natural disasters.

The researchers used high-speed image sequences -- 500 frames per second -- of hummingbirds hover-feeding within a white plume (emitted by the heating of dry ice) to study the vortex wake from multiple perspectives. They also used particle image velocimetry (PIV), a flow-measuring method used in fluid mechanics, to quantitatively analyze the flow around the hummingbirds. PIV allowed the researchers to record the particles surrounding the birds and extract velocity fields.

The films and velocity fields showed two distinct jets of downwards airflow -- one under each wing of the hummingbird. They also revealed that vortex loops around each jet are shed during each upstroke and downstroke.

The researchers therefore propose in their paper published online last month in the journal Experiments in Fluids that the hummingbird's two wings form bilateral vortex loops during each wing stroke, which is advantageous for maneuverability.

"Previous studies have indicated that slow-flying bats and faster flying birds produced different structures in their wakes," said Douglas Altshuler, formerly an assistant professor of biology at UC Riverside, whose lab led the research. "We have been investigating the wake structure of hovering hummingbirds because this allows us to decouple the effects of different types of wings -- bat versus bird -- from different forward flight speeds.

Hummingbirds each weigh 2-20 grams. Because they can hover with high precision, they are able to drink nectar from flowers without any jiggling movement to their bodies. Besides using upstrokes and downstrokes, hummingbirds can rotate their wings. They can even flap their wings from front to back with a 180-degree amplitude.

"We began this study to investigate how the hummingbird used its tail while hovering," said Marko Princevac, an associate professor of mechanical engineering and a coauthor of the research paper. "After all, many insects also hover, but they have no tail. Instead, however, our research showed something interesting about the hummingbird's wings: the bilateral vortex structure. Hummingbirds hovering should cost a lot of energy but these birds are able to hover for long periods of time. Ideally, unmanned vehicles need to be operated with a very limited energy supply, which is why understanding how the hummingbird maximizes its use of energy is tremendously beneficial."

Sam Pournazeri, a former Ph.D. graduate student in Princevac's lab and a co-author on the paper, explained that in a downstroke, the air pressure difference developed as a result of wing movement creates flow from the bottom to the top of the wing. The result is a circular movement or vortex.

"Based on theories in fluid mechanics, this vortex should close either on the wing/body or create a loop around it," he said. "It's these loops that provide circulation around the wings and cause the hummingbird to overcome its weight. Hovering requires the bird to create a lift that cancels its body weight. Although the two-vortex structure we observed increases the hummingbird's energy consumption, it provides the bird a big advantage: a lot more maneuverability."

Next, the research team plans to study the hummingbird in a wind tunnel to closely observe how the bird transitions from hovering to forward motion, and vice versa.

"Current technology is not successfully mimicking how living things fly," Princevac said. "Drones don't hover, and must rely on forward motion. Research done using hummingbirds, like ours, can inform the development of the next generation of drones."

Pope changes conclave rules, allows earlier start if all cardinals in Rome before 15-day delay

VATICAN CITY - Pope Benedict XVI has changed the rules of the conclave that will elect his successor, allowing cardinals to move up the start date if all of them arrive in Rome before the usual 15-day transition between pontificates.

Benedict signed a legal document, issued Monday, with some line-by-line changes to the 1996 Vatican law governing the election of a new pope. It is one of his last acts as pope before resigning Thursday.

The date of the conclave's start is important because Holy Week begins March 24, with Easter Sunday March 31. In order to have a new pope in place for the church's most solemn liturgical period, he would need to be installed by Sunday, March 17 ? a tight timeframe if a conclave were to start March 15.

Yoshida told Engadget that <b>Sony</b> is asking developers to try out Remote Play before submitting their games for publishing. He also mentioned that developers could add extra control customization using the Vita. "Some PS Vita games make use of the edge of the screen to add contextual buttons--that works really well, I think, and it's easy to see," he said. Huskies travel to Florida for Strike-out Cancer Tournament

After rain muddied up the schedule in Miami last weekend, the UConn softball team is hoping for sunnier skies in Boca Raton, Fla. this weekend at the Florida Atlantic University Strike-Out-Cancer Tournament.

While originally scheduled to play five games, the Huskies only played four due to inclement weather in last weekend?s tournament at Florida International University. They successfully defeated Morehead State, split a pair with Binghamton and lost one to Florida International, giving them a 2-2 record to start off the season.

At this weekend?s tournament the team will face five teams over the span of three days, barring any additional weather complications.

First up in the tournament are Towson (4-6) and Florida Atlantic (3-6), with the games currently scheduled to take place later today. On Saturday, they will face Northern Illinois (3-2) and Big East-rival Providence (0-0). The tournament will conclude on Sunday when the team takes on North Florida (8-3).

The last time UConn and Florida Atlantic met, the Huskies fell 3-0 in a tough loss at the FAU Tournament last season. However, the last time UConn and Providence met, Connecticut walked away with a 10-0 victory after a five-inning mercy rule win last April in Storrs.

All eyes will be on freshman Alyson Ambler, who had an impressive performance on the mound in Miami. Ambler played a pivotal role in both of the team?s wins last weekend, pitching 8.0 innings to give the team their first win as well as relieving Saveriano and earning the save in their second win.

The Huskies will also be hoping for a strong performance again from junior Maddy Schiappa at the plate. Schiappa went 9-for-14 (.643) at FIU last weekend, the best of anyone on the team.

Coach Karen Mullins indicated last week that the first three tournaments in February would serve as an opportunity for the team to find a level of cohesiveness that will give them success throughout the season. Mullins believed that finally having time playing on the grass would help get the team ?in sync,? and as they played more games their overall performance would improve.

The forecast for this weekend shows nothing but warm temperatures and clear skies in the Sunshine State; so weather-based postponements should be virtually non-existent. The Huskies are anticipating that these predications will be matched in reality as they look to continue into their second weekend of the season.

Vietnam vet, teen bring Scouting to Afghanistan

Keith Blackey, a veteran of the Vietnam War, has a lifelong involvement with scouting. He has brought his passion for scouting to Afghanistan as a way to say thank you and make a difference. NBC's Mandy Clark reports.

KABUL, Afghanistan - A 68-year-old Vietnam veteran and an idealistic 13-year-old boy might seem unlikely partners. But these two Boy Scouts -- 55 years and 7,000 miles apart -- joined forces to help some of the poorest people in Afghanistan.

Maryland teenager John Ferry needed a project to become an Eagle Scout, the highest rank attainable in the Scouts. He learned that Army Maj. Kenton Barber who was serving in Afghanistan needed donations of shoes to give to Kabul street kids.

Ferry emailed Barber to see how he could help. The boy did not want to stop at shoes, and so contacted schools, local businesses, churches and senior centers for help collecting more than a ton of winter clothes. He says he could not believe there were kids his age that still froze to death every winter in Afghanistan.

Keith Blackey?s path to Afghanistan began 60 years ago as a fighter pilot in Vietnam. In Sept. 1968, he was shot down during an intelligence gathering mission over North Vietnam.

?My wingman was with me and he could have escaped because we were under terribly heavy fire from surface to air missiles but instead he risked his life, followed me in and saw where our parachutes landed,? he said.

A3 Warrior pilot Blackey was taken captive by the North Vietnamese. A Marine unit launched a rescue operation within three days, and Blackey?s wingman, Lt. Cmdr. Chip Beck, rescued him. Over the years the two stayed in infrequent touch.

John Ferry, a 13-year-old Boy Scout from Kensington, Md., helped get about a ton of winter clothes to some of the poorest people in Afghanistan.

Forty years later, Beck asked a favor.

?What do you say to someone who has saved your life and he asks you to do something? There is no answer except yes,? Blackey said.

Beck asked Blackey to help build up the Iraqi scouting program. Six years later, Blackey had built a network of 150,000 Scouts.

Today Blackey is in Afghanistan hoping for the same success. ?After three months in Kabul, 2,000 Scouts have been signed-up -- so far, all orphans.

Blackey calls the program ?a game with a purpose.?

It is about having fun but also about learning guiding moral principles, manners, teamwork and leadership ? skills orphans badly need, he says.

Back in Kensington, Md., John Ferry had a ton of clothes but could not find a way to get it to Afghanistan.

?I was never discouraged, there was times it was slow going but I was not discouraged,? Ferry said.

He finally got in touch with a U.S. military program that agreed to ship them for free.

Enter Blackey. Once all the clothes arrived in Kabul, Blackey and his Scouts took over. ?They loaded the shipment onto a truck bound for the Northern province of Bamiyan.

?The Scouts that helped both in Kabul and in Bamiyan, they are all orphans, many of them are living in poverty, and their scout uniform is the nicest thing they have,? Blackey said.

Despite their own poverty, the Scouts in Bamiyan wanted to help those in the most need, so Blackey handed out the clothes to some of the poorest people ? those who live in caves in cliffs where the famed Bamiyan Buddhas once stood.

?It is a really depressing lifestyle. It is cold, they have no heat,? he said. ??They share a room with their animals.?

The Scouts spent hours stuffing garbage bags with jackets, sweaters, shoes, hats and mitts for each family member living in the caves. The help reached over 100 families, or around 600 people.

What touched Blackey was, ?how gracious they were and their gratitude for these gifts.?

In Maryland, Ferry waited eagerly for news. The best part for him was seeing the photographs.

?I recognized some of the clothes,? he said.

Asked why he took on such a big project, Ferry said, ?If you do a good deed for a stranger, maybe they will do another deed for another stranger. ?But this was the right thing to do. It is just natural to help out those in need.?

Blackey?s motivation runs deeper.

?For two wars I have proven to myself that bombing adults does not solve the problem. For my last two wars instead of wearing a military uniform, I?m wearing the Scout uniform,? he said.

?I really believe we are going to do more for the future than I was ever able to do for my first two wars.?

Is the Muslim Brotherhood seeking to kill Egypt's NGOs?

A restrictive draft law sponsored by a member of the Muslim Brotherhood's party echoes the philosophy of the Mubarak government, which saw independent groups as a threat.

A government minister and member of the Muslim Brotherhood's Freedom and Justice Party (FJP) has proposed a highly restrictive law that rights activists say would cripple civil society groups in Egypt and mark an alarming shift by the Brotherhood toward the methods of the ousted Hosni Mubarak.

The draft law is likely to be revised before it is sent to Egypt's legislative body for approval. Even so, nongovernmental organization (NGO) leaders and activists say the draft shows that the FJP is adopting the philosophy of former President Mubarak, whose government saw independent groups as a threat and sought to restrict their actions and funding.

Last year, before the FJP's Mohamed Morsi was elected president, the party proposed a law that earned cautious praise from rights organizations. Last week, Mohamed Ali Bishr, a prominent Muslim Brotherhood and FJP member and minister of local development, proposed a new draft that is closer to the highly restrictive bill proposed by another government ministry.

It would interfere in the details of how NGOs operate and organize, and would tightly restrict the foreign funding that rights organizations in Egypt rely on. For the first time in history it would give a legal role to Egypt's security apparatus in overseeing civil society organizations.

If a law much like the current draft passes, ?NGOs will not work actively. They will work under the pressure of the law and the government; they will not be healthy NGOs. There's no hope for those that work in human rights or criticize the government on human rights to obtain foreign funding,? says Mohamed Zaree, Egypt program manager at the Cairo Institute for Human Rights Studies (CIHRS).

Mubarak's time

Mubarak's government saw civil society organizations, particularly those focused on human rights, as a threat. Most rely on funding from abroad, and he sought to restrict or control that funding. When Mubarak was ousted by a popular uprising in 2011, the military stepped in to rule Egypt, but the officials responsible for regulating civil society remained. They launched a crackdown on NGOs that were foreign or received foreign funding, raiding offices, confiscating cash and equipment, and investigating employees.

They eventually brought charges against 43 people, including Americans, accusing them of receiving foreign funds illegally. In public statements leading up to the trial, officials implied those charged had been working to destabilize Egypt. Most of the Americans fled the country last year, but one remained to face the charges.

When the FJP proposed a draft NGO law last year, the military was still ruling Egypt. In at least one article of that draft law, the Brotherhood's party took almost word for word the recommendations made by CIHRS and other rights organizations. Rights activists say the law did have portions they considered problematic, but on the whole it was progressive. They were startled to see the FJP's new draft revert to the vision outlined by the Ministry of Insurance and Social Affairs, which has advanced the Mubarak-era approach toward NGOs.

Amnesty International said yesterday that the Ministry of Insurance and Social Affairs recently sent a letter to the Egyptian Organization for Human Rights saying that local organizations are not allowed toengage with ?international entities? in any way without the permission of the ?security bodies, " apparently on the instructions of the prime minister.?

The first draft law ?was introduced by the Muslim Brotherhood in different political circumstances,? says Bahey el Din Hassan, head of CIHRS, noting that a military junta was then ruling Egypt. Now, with Morsi as president and the FJP dominating the only legislative body currently active, ?they have everything. So why would they make concessions to civil society? This is what changed."

Mr. Zaree says the draft law was presented in a meeting at the Justice Ministry attended by CIHRS as the FJP's proposal. FJP spokesman Mourad Ali would only say that the draft law is still being discussed and is not finalized. He declined to answer further questions, as did other FJP members.

An official at the presidency, who asked not to be named, said "the presidency is keen on building consensus on the associations law. No NGOs law has been submitted to the Shura Council [Egypt's legislative body] yet. We have urged the cabinet to withhold submitting a draft law until a more consensual version is in place."

Damage done

Heba Morayef, Egypt director for Human Rights Watch, says the damage is done when those writing the law start with such a repressive draft, even if they promise revisions. ?The problem is that once you adopt language that is very restrictive, even when you attempt to revise it, the revisions tend to be limited,? she says. ?The first draft is very significant.?

The FJP draft law calls for foreign funding to be tightly restricted. It requires organizations to receive prior approval from a government minister before they can receive funds, and the minister doesn't have to justify a decision to say no. Already, under the current law, authorities are rejecting or holding up many organization's applications for approval to receive funds from abroad, says Zaree.

Mr. Hassan says the ministerial veto could be used against organizations the government sees as a nuisance ? for example, those working to document torture or abuse by security forces.

The most worrying article for many in NGOs is one that designates all NGO funds except member dues as ?public funds.? Zaree, Egypt program manager at CIHRS, says it takes the ?non? out of ?nongovernmental organizations? and ?nationalizes? civil society. That designation would give the government greater oversight and allow it greater interference in NGO work ? including allowing several government entities the right to review the activities and finances of NGOs at any time, says Zaree.

?This gives you a sense that they look at civil society as a branch of the government. It's not independent,? he says.

Next stop: Jail

Hassan says the law means ministry officials can come to an NGO's offices at any time, review anything they want ? related to activities or finances ? and refer the employees on the spot to the prosecutor.

The law would also set up a committee to approve the registration of international NGOs. That committee can reject the registration request of any organization if it decides that Egyptian society is not in need of its work ? for example, if the committee members decide there is no need for investigating torture or raising political awareness. ?It's a very very broad criteria,? says Zaree.

International NGOs that receive foreign government funding, either directly or indirectly, would not be allowed to work in Egypt. That would immediately disqualify many organizations, including the International Republican Institute and the National Democratic Institute, both American organizations targeted in the NGO crackdown. They are affiliated with the Republican and Democratic parties in the US, and receive most of their budget from the government's National Endowment for Democracy.

For local NGOs, the law interferes in minor details of how they organize themselves. Those that receive foreign funding would be required to submit a quarterly report on their activities and finances to the government. That puts an unreasonable burden on NGOs, who would spend most of their time writing those reports instead of working, says Zaree. And the law mandates prison sentences, instead of fines, for those who break the law.

Rights advocates say the regulations in the law would effectively prohibit many international NGOs from working in Egypt, and greatly hinder or stop the work of local NGOs as well. Asked if CIHRS could operate under the draft law, if it were implemented, Hassan said, ?if it was passed like this, I don't think it would be possible. If we didn't shut down they would come and shut us down.?
